Terms of Service

These terms govern your use of Banksia, a service of Yuma IT Pty Ltd (ABN 62 684 389 839). By requesting an assessment, booking a session, or otherwise using Banksia, you agree to them.

1. Who these terms are between

These terms are an agreement between you (and the business or organisation you represent) and Yuma IT Pty Ltd (ABN 62 684 389 839), trading as Banksia (“we”, “us”, “our”).

If you are agreeing on behalf of a business or organisation, you confirm you are authorised to bind it, and “you” means that entity.

2. What Banksia is

Banksia assesses the publicly accessible pages and well-known files of a website and reports on whether AI agents can discover, read and act on it. We also offer managed remediation, where we carry out fixes for you under a separate scope and quote.

Banksia is an assessment and remediation service. It is not a website builder, not a hosting provider, and not a search-engine optimisation service.

The specific signals a report covers change as this field develops. The current scope is published at what we check, which separates what we assess today from what we intend to add.

3. Your authority to request an assessment

By submitting a website address you confirm that you own that website or are authorised by its owner to have it assessed. You must not submit a website you have no right to submit.

You are responsible for anything done under your account or from a verified email address you control. If you believe an assessment was requested for your website without authority, contact us at [email protected] and we will investigate and, where appropriate, delete the results.

4. How we access your website

We read only pages your website already publishes to the public. We do not attempt to access anything behind a login, and we never ask for credentials or administrative access.

Crawling begins only after the submitted email address is confirmed. Requests are rate-limited, and we refuse targets on private networks. We identify ourselves in our requests and respect a reasonable crawl budget.

5. What we do not promise

This is the most important section on this page, so it is stated plainly:

  • We do not guarantee search rankings. No provider can. Search engines do not accept payment or instruction for position, and their ranking systems are not disclosed.
  • We do not guarantee inclusion or citation in AI assistant answers. Whether an assistant mentions your business is outside anyone’s control.
  • We do not guarantee traffic, leads or revenue as a result of any finding or any remediation work.

Some signals we measure rest on conventions that are still settling, such as llms.txt. Those findings are labelled experimental in every report. You should weigh them accordingly rather than treat them as settled practice.

Reports are informational and reflect what your website published at the time of the assessment. They are not legal, accessibility compliance, or security certification advice. An agent-readiness score is not a statement of conformance with WCAG or the Disability Discrimination Act 1992 (Cth), and is not a penetration test or a security audit.

Many of the standards in this area are drafts or proposals that may change or be abandoned. Implementing a recommendation based on a draft specification carries the risk that the specification changes. We label the maturity of every standard we reference so you can weigh that risk, but we do not warrant that any third-party specification will be adopted or maintained.

6. Acceptable use

You must not:

  • submit a website you do not own or are not authorised to submit;
  • use Banksia to assess a competitor’s website without their authority;
  • attempt to interfere with, overload, probe or reverse engineer the service, other than reporting a vulnerability as described on our Security page;
  • use the service to break any law, infringe anyone’s rights, or send unlawful or harmful material;
  • resell, sublicense or present our reports as your own work without our written agreement; or
  • use automated means to extract our content, other than crawling that respects our robots.txt.

We may suspend or terminate access if you breach these terms, and where practical we will tell you why.

7. Fees

The assessment and its report are free, and no payment details are required to obtain them. Remediation work is quoted separately. We will not begin chargeable work, and you will not owe us anything, until you accept a written quote.

Unless a quote says otherwise, fees are in Australian dollars, exclusive of GST where GST applies, and payable within 14 days of invoice. See Pricing for how the free assessment and paid remediation fit together.

8. Intellectual property

Your material. You keep all rights in your website, your content and your data. You grant us a limited licence to access your public pages and to store and process the results, solely to provide the service to you.

Your report. The report we produce for you is yours. You may keep it, share it, and act on it — including by giving it to another provider to do the work.

Our material. We keep all rights in Banksia itself: the platform, our assessment rules, scoring methods, templates and branding. Nothing in these terms transfers those to you.

We may use aggregated, de-identified information derived from assessments to improve our rules and scoring. This will never identify you or your website.

9. Privacy

Our Privacy Policy explains what personal information we collect, why, who we share it with, and how to access, correct or delete it. It forms part of these terms.

10. Availability

We aim to keep Banksia available and accurate, but we do not promise uninterrupted service. We may change, suspend or withdraw features, and we will give reasonable notice where a change materially reduces functionality you rely on.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the service.

12. Liability

Subject to section 11, and to the extent permitted by law:

  • we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings;
  • we are not liable for decisions you make in reliance on a report, or for the acts or omissions of any third party you engage to act on one;
  • we are not liable for loss caused by inaccurate information you gave us, by changes to your website after an assessment, or by changes to third-party search or AI systems; and
  • our total liability arising from the free assessment and report is limited to re-performing the assessment or, where we cannot, to AUD 100. Our total liability for paid remediation work is limited to the fees you paid us for that work in the 12 months before the claim.

13. Indemnity

You indemnify us against claims, loss and reasonable costs arising from your breach of these terms, and in particular from your submitting a website you were not authorised to submit.

14. Ending this agreement

You may stop using Banksia at any time, and may ask us to delete your data as described in our Privacy Policy. We may end or suspend your access if you breach these terms, or if we discontinue the service, in which case we will give you reasonable notice and a chance to retrieve your reports.

Sections that by their nature should survive termination — including intellectual property, liability and indemnity — do so.

15. Changes to these terms

We may update these terms as the service changes. The effective date at the top of this page shows when they last changed. Material changes take effect on the date we publish them, or on a later date we nominate. If you keep using Banksia after that date, you accept the updated terms.

16. Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that territory and of the Commonwealth of Australia.
